Komposed Privacy Policy

The services offered by Komposed.com ("Komposed" or "we") include the Komposed.com website (the "Komposed Website"), the Komposed mobile software, and any other features, content, or applications offered from time to time by Komposed, LLC, a California limited liability company ("Komposed"). A User is any person, business, or company that has browsed the Komposed Website, is a Komposed Member (which means that you have registered with Komposed in any form including but not limited to writers, labels, artists, performance rights organization, publicist, publishing company, administrative company, and the like), or has used the Komposed Services, whether knowingly or unknowingly.
Komposed is committed to providing a safe, secure User experience. We collect information about you when you interact with the Komposed Services, both by directly asking you to provide us with such information and by automatically collecting it, through use of technologies. When using any of our Komposed Services you consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy. Irrespective of which country you reside in or supply information from, you authorize Komposed to use your information in the United States and any other country where Komposed operates.
Information Collection
(a) User submitted information: Komposed collects User submitted information, including, but not limited to, name, age, hometown, bio, music genre, birth date, address, location, musical publishing information, favorite artists, favorite instruments, musical accomplishments, sound recording data, professional affiliations, unpublished and published song data, image data, information about songs and song titles, song lyrics, song details, song classification, e-mail address, written text, mobile number and data, video data, remarks, suggestions, graphics, tags, hashtags, genres, splits, ownership splits, identifiable numbers, identifiable codes, affiliated companies or individuals, rights holder, administrator, publisher, or any other materials (collectively, "Information Content") that you display, upload, transfer, publish, or post to Komposed, whether public or private.
(b) Anonymous information: Komposed may also log anonymous information including IP address, profile information, aggregate User data, mobile data, and browser type from Users of the Komposed Services.
(c) All information identified in paragraphs (a) & (b) above is collectively known as "User Information".
How the User Information is Used
(a) When User Information is posted on the profile page, the User has a choice to allow that information to be public or private. If a User chooses "private," the User controls who views the information. If a User chooses "public," the information is accessible by a search engine. Komposed collects the User Information, which it may share with third parties, including approved sponsors, to provide more useful and personalized services. Komposed may use the User Information to send updates or news to User. The User Information may be shared if it is legally required to do so, such as by a court order. The User Information may also be used by Komposed, its employees, agents, and affiliates to manage the Website, track usage, and improve the Website.
Once User Information has been submitted, Komposed may share or disclose User Information to engage service providers or other business affiliates, subject to confidentiality obligations consistent with this Privacy Policy. As we continue to develop our business, we might sell, buy, or license assets. In such transactions, User Information may be one of the transferred assets but remains subject to the promises made in this Privacy Policy. In the event that Komposed is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your User Information may be sold or transferred as part of that transaction. The promises in this Privacy Policy will apply to your information as transferred to the new entity.
(b) When you decide to post content, comments, or other materials to another member's profile, or elsewhere on the Komposed Website, that information may be disclosed, and available to third parties consistent with the visibility settings for the relevant profile or content, even if those settings are inconsistent with your own profile Settings. Pages are generally publicly available, which means that posts that you make on those pages will likely be available to anyone. In addition, your Information Content and selections may be part of your profile as well as any content pages that you view.
(c) Delays and errors in effecting your profile and/or preferences may occur and we do not represent that they will be immediate, complete, error-free, current, reliable or accurate. Cookies
Komposed uses cookies to (1) identify Users' Internet browser, (2) store Users' preferences and mobile information, and (3) potentially determine whether Users have installed enabling software needed to access certain material on Komposed. Data in cookies may be read to authenticate User sessions or provide services. You can program your computer to warn you each time a cookie is being sent, block third-party cookies, or block all cookies. However, by blocking all cookies you may not have access to certain features on Komposed.
Third-Party Advertising and Cookies
Ads appearing on the Website may be delivered to the User by Komposed or one of Komposed's advertising partners. Komposed's advertising partners may set cookies. These cookies allow the ad server to recognize a User's computer. Ad servers may compile information about the location of a User. This information allows an ad network to deliver targeted advertisements. Advertisers' uses of cookies are subject to their own privacy policies, not the Komposed Privacy Policy.
Links
Komposed utilizes links to other websites. Komposed is not responsible for the privacy policies and/or practices of those websites. When linking to another website, a User should read the privacy policy stated on that site.
Forums, Video, Chat Rooms, Message Boards and Personal Pages
Whenever a User voluntarily posts information to public forums, chat rooms, video pages, message boards and/or personal pages, that information can be accessed by the public to send a User unsolicited communications. Any user posting information to a public forum does so at his/her own risk.
Promotions & Contests
Komposed may periodically send promotional materials or notifications related to Komposed Services or the services or products of Komposed partners to the e-mail address you provided to us. By using Komposed Services, you consent to the receipt of promotional materials or notifications to your e-mail address or profile(s).
We may offer sweepstakes, contests, and other promotions ("Promotions") through the Komposed Services that may require registration. By participating in a Promotion, you are agreeing to official rules that govern that Promotion, which may contain specific requirements of you, including, allowing the sponsor of the Promotion to use your name, voice and/or likeness in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, personal information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion's official rules, such as on a winners list.
Protecting Children's Privacy
Komposed understands the importance of protecting children's privacy in the interactive world. We do not use the Komposed Services to knowingly collect personal information from children under the age of 13 without parental consent. If you are a child under 13 years of age, you are not permitted to use the Komposed Services and should not send any information about yourself to us through the Komposed Services.
In the event that Komposed becomes aware that we have collected personal information from any child, we will dispose of that information in accordance with the Children's Online Privacy Protection Act and other applicable laws and regulations. If you are a parent or guardian and you believe that your child under the age of 13 years old has provided us with information without your consent, please contact us at support@Komposed.com and we will take reasonable steps to ensure that such information is deleted from our systems.
Security
Komposed has implemented commercially reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access and/or use. However, Komposed cannot guarantee the security of User Information. You understand that Komposed cannot and does not guarantee or warrant that files available for downloading, uploading, and/or viewing on Komposed Services will be free of viruses, works, Trojan horses or other code that may manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy particular requirements for accuracy of data input and output, and for maintaining a means external to this site for any reconstruction of any lost data. You will be solely responsible for the security of your password and the private settings related to Content.
Disputes
If there is any dispute about or involving this Privacy Policy, the User agrees that the dispute shall be governed by the laws of Los Angeles, California, without regard to conflict of law provisions, and the User agrees to exclusivepersonal jurisdiction and venue in the state and federal courts of the United States located in the State of California. If an action is brought to enforce the terms of this Privacy Policy, then the prevailing party in that action shall be entitled to recover its costs and attorneys' fees from the non-prevailing party.
Changes in Policy
Komposed has the right to change periodically this Privacy Policy without notice. Komposed will post all changes to its Privacy Policy on the homepage, www.Komposed.com.
